This privacy policy governs your access or use of content, products, and services made available by Cuverd, TranspareRx Corporation, Cuverd™, and its parents, subsidiaries, and affiliates (collectively, “Cuverd,” “TranspareRx,” “us,” or “we”).

Your use of our Services, including any dispute concerning privacy, is subject to this Privacy Policy and our Terms and Conditions. By using our Services, you are accepting this Privacy Policy and our Terms and Conditions and you are authorizing the terms and disclosures set from this point forward. If you do not agree to this Privacy Policy or our Terms and Conditions, do not access or use the Services. Please review this policy carefully to ensure your understanding of our privacy practices.

Information Provided and Collected

Information You Provide to Us

You may choose to provide us with information to receive certain Services. We may collect some or all information through various forms and in various places through the Cuverd Service and our Site, including account registration forms, reminder forms, Contact Us forms, or other interactions. The current data fields include, but are not necessarily limited to:

  • First and last name
  • Mailing address
  • Email address
  • Password
  • Home phone number
  • Mobile phone number
  • Insurance coverage information
  • Credit card number, expiration date, and security code and/or information regarding your PayPal, Google Wallet, or other digital payment accounts
  • Demographic information (age, gender, etc.)
  • Health, prescription, pharmacy, and related information
  • Content of messages from you to us
  • Driver’s license or other government identification numbers

If you choose to provide us with information about any other individual, you represent and affirm that you have permission to provide this information to us.

You agree to let us use and share the information you provide in order to provide the Services and to run our business (including for the purposes of business operations, analytics, development, marketing, and optimization).

You agree that Cuverd may contact you by mobile phone, telephone (including by an automatic telephone dialing system), and/or email at any of the phone numbers and/or email addresses provided by you. Should you send Cuverd an SMS message or email, such message constitutes your prior agreement to receive the messages you request in response to that SMS device or email. You understand that you are not required to provide this consent as a condition of purchasing any property, goods, or services. You also understand that you may opt out of receiving marketing text messages or emails from Cuverd at any time.

Situations in which you may provide us with information include but are not limited to:

  • When you register for an account
  • When you sign up for price alerts, refill savings communications, and/or promotions
  • When you email or text a coupon to yourself
  • When you email or text a coupon to others
  • When you use a discount card or coupon
  • When you communicate with us via phone, text, chat, email, website contact form, or any other means

Information Collected

In addition to any information that you choose to submit to us, we and the third parties we work with may use a variety of technologies to collect certain information. This information includes but is not limited to:

  • Geolocation information
  • Internet Protocol (IP) address
  • Information about your computer operating system and browser, such as its maker or version
  • The pages and content of our websites/screens that you view (including URL and screen name)
  • Referral websites
  • Unique identifiers
  • Login information
  • Information about your mobile device, such as the telephone number, mobile device ID, and the make, model, operating system, capacity, and settings of your device
  • The type of internet browser you are using
  • Your preferred language
  • Information that allows us to personalize your Cuverd experience
  • Information, content, or ads you view, hover over, or interact with on the app and/or website

We and/or third parties we work with collect this information using technologies including but not limited to the following:

  • Cookies. Cookies are data files placed onto a computer or other device when it is used to access our Services. We use cookies to collect, store, and sometimes track information for statistical purposes in order to improve the services we provide. If you are a registered user for any Service, we will use cookies to save your settings and to provide customizable and personalized services. The information collected will be associated with your account.

    If you do not want information to be collected by cookies, your browser and/or device may allow you to disable and/or control the use of cookies. We do not control the use of any cookies that are deposited on your computer when you visit third-party websites and we expressly disclaim responsibility for information collected through them.

    If you do not want your information to be collected using cookies, your browser allows you to deny the use of cookies. Cookies can be disabled through a setting preference within your browser.

  • Web beacons. Web beacons are small graphic image files that collect information about your use of and interactions with the Services. These may be included in our pages and are used to track the online interactions and movements of our users.

  • Embedded scripts. An embedded script is programming code that functions to collect information about your use of and interactions with the Cuverd Services. Embedded scripts are only active during your Cuverd session.

  • Remarketing technology. We may permit third parties to collect your personal information over time or across third-party websites, mobile applications, and/or online services, including those that assist us in operating our Services.

  • Plug-ins. Plug-ins are a software component that add a specific feature to an existing program. Plug-ins are the responsibility of the plug-in provider, and we have no control over the information that the respective provider collects through its plug-in or how that provider uses such information. If you are not yet a user of the provider or have not consented to having your data collected and used by that provider, you should not click on those plug-ins. If you are already a user of the plug-in provider, you should refer directly to the relevant provider for information on the kinds of personal data that the provider collects and uses.

By using our services, you agree to let us use and share such information in order to provide our service to you, run our business, and communicate and market to you.

Information You Provide to Third Parties

We receive information about you from third parties, including but not limited to:

  • Marketing partners. We may work with third parties to conduct marketing campaigns and/or receive information for potential users of our services. Third parties may collect and provide to us personal information such as your name, contact information, medical information, and demographic information.

  • Data partners. We may in some cases supplement the information we collect about you with information from third parties, including data regarding your online activities across devices and online platforms.

  • Pharmacy benefit managers. Most prescriptions purchased in the United States result in the pharmacy reporting patient data back to the company that provides the service.

By using the Cuverd Services, you agree to let us use and share such personal information in order to provide services to you, run our business, and communicate and market to you.

Advertising on the Cuverd App or Website

We use third-party advertising companies to serve ads when you use Cuverd services. Third-party advertising companies may collect information from our services and other websites and mobile applications in order to provide advertisements about goods and services of interest to you. Cuverd adheres to HIPAA and Digital Advertising Alliance principles.

Behavioral advertising uses information collected from an individual’s web or mobile browsing behavior, such as the pages they have visited or the searches they have made. This information is then used to determine which advertisements should be displayed to a particular individual.

When do we share your identifying information with a third party?

Cuverd does not sell our users’ personal medical information. We do not provide your personally identifiable medical information to any party in exchange for payment.

We use your personal information in order to provide services to you, run our business (including for the purposes of internal business operations and analytics, and to provide, change, market, or optimize our services and products), and communicate and market to you. In some instances, we may use third parties to help assist us in providing you with the best experience.

Here are some examples of when we may share your information with third parties:

  • To market and advertise to you
  • To send you discount cards, coupons, and/or manufacturer copay cards
  • To process your credit card information (when provided by the user) and track payments
  • To supplement our data
  • To fulfill, deliver, develop, and enhance services and products
  • To store and analyze data

Children’s Personally Identifiable Information

Cuverd is not intended to be used by children or minors. If you are under the age of 18, please do not attempt to register with us or provide any personal information. We assume our services are used by adults. We do not knowingly collect identifying information from minors under the age of 18. We respect the privacy of parents and children. Additional Privacy-Related Information

Security

We cannot ensure the security of any information transmitted to us over the internet or by other electronic means (such as text messages), and we accept no liability for any unintentional disclosure.

User information is stored within our databases using standard security practices. We also implement other security measures as required by law. However, due to the possibility of hacking, we cannot guarantee the security of our databases, nor can we guarantee that user information won’t be intercepted while being transmitted to us over the internet or wireless communication, or accessed while stored on our service providers’ servers, and any information you transmit to us is done at your own risk.

To help us protect your information, we strongly encourage you to keep your username and password private.

Visitors outside the United States

Please do not use the services if you are not a resident of the U.S. Cuverd services are intended for use only by U.S residents at participating pharmacies.

Deletion Requests and Opt-Outs

All users nationwide can request the deletion of their data.

To unsubscribe from marketing text messages, please visit your settings.

To unsubscribe from marketing emails, please use the link located at the bottom of the marketing email. After opting out of marketing messages, you may still receive transactional messages about your Cuverd account.

Account Changes and Cancellation

Accuracy Changes

You are responsible for maintaining the accuracy of your personal information. If your information changes, you may correct, delete, or amend your account information by visiting our account settings page.

Retention of Information

We will retain your user information for as long as your Cuverd account is active. Even after your account is terminated, we may keep some necessary information to comply with our legal and regulatory obligations, for our internal business operations, and to resolve disputes.

Canceling Your Account

If you cancel or suspend your account, we may still use the information about your prior use of our services to improve our services, provide you with discounts, and market to you (except if you have opted out).

Changes to This Privacy Policy

We may periodically make changes to our privacy policy. When we do so, we will post the revised Privacy Policy on our Services. Please check the revision date at the top of this page to determine if the policy has been modified since you last reviewed it. The modified Privacy Policy will be effective immediately upon posting. Your continued use of the services after the posting of the modified Privacy Policy constitutes your agreement to abide and be bound by it. We encourage you to periodically review this page for our most updated privacy practices. If you object to any modification, you will be obliged to stop using the services.

Your Rights and Choices

The CCPA provides consumers with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you
  • The categories of sources for the personal information we collected about you
  • Our business or commercial purpose for collecting that personal information
  • The categories of third parties with whom we share that personal information
  • If we disclosed your personal information for a business purpose, a list identifying the personal information categories that each recipient obtained

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities
  • Debug products to identify and repair errors that impair existing or intended functionality
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right protected by law
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq)
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement (if you previously provided informed consent)
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us
  • Comply with a legal obligation
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it

We do not provide these deletion rights for business-to-business personal information.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

  • Emailing us at support@Cuverd.com. Please include the following fields in your email:
    • Full name
    • Email address
    • Date of birth
    • Mailing address
    • Phone number

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password-protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in a verifiable consumer request to verify the requester’s identity or authority to make the request.

Nondiscrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties
  • Provide you a different level or quality of goods or services
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services

Changes to Our Privacy Notice

We reserve the right to update and periodically amend this Privacy Policy at our discretion and at any time. If we make changes to this Privacy Policy amendments will be posted online, and the date of the update will be included. Your continued use of this site and affiliated sites after any such update indicates your agreement with the amended policy.
